Podcasting Springsteen
Question: How come you can’t “podcast” copyrighted music, but radio stations/ MTV/internet radio streams are allowed to “broadcast” the same thing?
Answer: When you listen to the radio, watch MTV or stream audio from your favorite net feed, you get to listen to what is being broadcast in “real time” but you are not capturing the copyrighted material (song) and saving it to your hard drive for future use.
However, a “podcast” is merely a subscription (automatic download) to an MP3 file.
The line is crossed when you go from broadcasting/streaming audio (that forces you to listen in real time for your favorite song) to OWNING it for “on-demand” use like a 45 single, CD and now MP3.
Currently, record companies are re-evaluating this tight-knit strategy of not allowing music to be podcast. Why? Out of site, out of mind. A few record companies now realize, if people are plugging iPod adapters into their car stereos (bypassing FM) — their new artists, not getting major MTV/Pop Radio airplay, won’ t be heard. So smart record companies realize, “Let the general public use our hit music in their podcasts as the new and innovative way to reach our audience the same way a 45 single promoted the LP in the “old days.” If not, just like MTV gave birth to a roster of new stars not getting FM airplay (U2, INXS, Duran Duran, Men At Work) — podcasting will give birth to a new roster of indie music stars who are willing to allow their music to be heard by the millions and millions of people switching over from AM/FM to iPod/MP3.
To summarize, the same reason you are supposed to go to iTunes to download your favorite song, instead of going to a free file-sharing site (remember the original Napster days), you are not supposed to “podcast” copyrighted material because it allows the user to permanently “own” the file without having to pay for it.
When you listen to the radio or a steaming audio feed, you get to enjoy the song or talk show as it happens, but once the moment is gone, all you have is a memory. Unlike a “podcast” where you are also left with a permanent MP3 file to listen to over and over, for the rest of time.
